Midwest Energy Association announced that its online learning portal has added five additional courses on topics from the Occupational Safety and Health Administration, as well as on electric operations and a combination gas/electric operation. MEAs online courses provide training and qualification for employees of utilities, pipelines and contractors for gas, electric, liquids and customer service.

Real estate practice is a broad and widely defined area of the law. In a pristine sense it deals with the esoteric subject of real property law and titles. In practice the subject matter handled by real property lawyers is much broader. Many of the areas of law within real estate practice are areas of specialty themselves. Real estate lawyers examine and evaluate real property titles, handle real estate sales, purchases and other transactions, foreclose mortgages, represent developers and contractors in drafting and negotiating development and construction agreements, handle real estate financing, structure and draft the governing documents for planned developments such as condominiums, serve as counsel to community and condominium associations, draft and negotiate leases, litigate title, boundary, and other land disputes, and advise clients respecting zoning and land: use matters. The examination of real estate titles requires knowledge of corporations and other forms of business organization, wills, trusts and estates, and a practitioner handling transactions must understand contractual, business, and tax subjects as well. The subjects that are tested on the certification exam attest to this diversity. They are title issues; real estate finance; environmental and land use; condominiums and homeowner associations; landlord tenant; closings; sellers, buyers, brokers, and title insurers; real property litigation; taxation of entities and other tax issues; and ethics. Some hold an impression that at least some aspects of the real estate practice are not challenging, that the practice is increasingly title company, form, and paralegal driven, and that when business is light any lawyer with a good paralegal can Ado real estate closings. This impression is not accurate. As with any area of practice, successfully representing clients in real estate matters requires knowledge, skill, and experience. The diversity in real estate practice may mean that no one lawyer can be an expert in each practice area encompassing the modern real property practice or that are tested by the certification program. That, however, is not a reason to not seek certification. The committee recognizes that few lawyers are likely to possess specific and detailed expertise in each of the many subjects that fall within the scope of real estate.

This part starts with a historical account of the role of the Central Bank of Canada since its creation in 1934. Then, the author develops an interesting chapter about the proper role of a central bank for financial stability by looking at the Canadian experience regarding bank supervision, settlement management, systemic and liquidity crises, and the lender-of-last-resort operation. The Central Bank of Canada never has been directly involved in the supervision of banks, and John Crow is rightly unhappy with this situation: The Bank and what it knows cannot be ignored in supervisory decisions regarding financial institutions (p. 77). The second part of the book analyzes the Canadian experience concerning foreign affairs. The most interesting part concerns exchange rate matters. Canada has a long tradition of a flexible exchange rate regime. The author shows the importance of communicating with financial market actors to limit disruptions in the exchange rate, but he also recognizes that the willingness to be transparent can lead to confusion instead of clarity (p. 120).

Q:ON DEC. 25, 2006, my wife and I gave our daughter and A: I called the Bank of America media relations in Charlotte, N.C., the banks headquarters, and was referred to San Francisco. Superior alternatives are readily available. In particular, metals such as gold and silver can be produced on purely free-market terms, that is, without requiring any form of legal privilege, and their quantities depend far less on any human beings arbitrary whims. No special reform measures are required to set up a metallic currency system, because gold and silver coins are likely to emerge spontaneously on a truly free market. The main element of a libertarian monetary reform is therefore to immediately abolish all forms of currency control (such as legal-tender laws, taxes on metals, and so forth). Moreover, all governments should give back the gold and silver that they stole from their citizens when they established their national fiat monies. On one vital point, however, Austrian economists have reached no consensus, and this disagreement has resulted in a lively debate in recent years. This debate does not relate to problems of money production and currency, but refers more narrowly to the production of money titles by financial service providers such as commercial banks. To understand the issue, it is useful to distinguish three types of financial services or banking.

Chapters 1 through 3 consider ship-building and -fitting, first the discrete native northern European traditions–keel, cog, and hulk–and then the interaction among these ship types and Mediterranean models such as the galley, carrack, and carvel. Two chapters are devoted to British horizons, foreign ships, and to trade, then the author turns to ports, inland water transport, and fishing, before concluding with sections on warfare, and on pilotage and navigation. Readers interested in Scandinavian sea-faring in the Middle Ages will find a dense, thorough, but highly readable discussion of the construction principles of the clinker-built ships of the Viking age and later (5-10), as well as some discussion of sailing properties (62). The chapter on North Sea and Baltic trade, however, treats the Nordic countries chiefly from the perspective of German, English, and Dutch efforts at monopoly (69-75), although there is a Good, if scattered, account of archaeological recoveries from Bryggen at Bergen. Nonetheless, as a survey intended for a nonspecialist readership, the book is a very successful synthesis of recent scholarship in an expanding discipline, one in which Grand theories can be instantaneously deflated by the publication of new material findings. The body of each chapter is overwhelmingly factual with only brief summarizing comment and little speculation. This approach to material reality leaves little room for the romance of the sea, and Hutchinsons rewarding discussions of sailing capabilities of various ship types and of differing mast and sail configurations, or even the repeated mention of the hazards of medieval sea-faring inject little human dimension into the survey. But there is no dearth of books that attempt to fill this gap, often in questionable fashion, and Hutchinsons adherence to strict criteria of archaeological relevance must not be counted a weakness.

CONVEYANCING was once the bread and butter of many small, high- street solicitors. The income from it was even used to subsidise the work of other departments. Not any longer. A threat to has emerged in the past year which is potentially more dangerous than furious price- cutting, the arrival of licensed conveyancers or the prospect of rocketing professional indemnity premiums. Shoosmiths Harrison, a solicitors firm with offices across the Midlands and South, developed its Property Direct conveyancing operation to work alongside Hambro Countrywides second call-centre, which opened in Northampton in June 1997. Shoosmiths has been able to offer its services to other clients, most recently Barclays Mortgages. Graham New, managing partner at Shoosmiths, is anxious to play down the impact of conveyancing call-centres on smaller firms, saying only that the telephone-based approach will gain a “substantial” rather than dominant market share. “The philosophy Hambro and the lenders have is not so much to make loads of money as to gain control of the house-buying process,” he says. “Direct lenders are becoming more sophisticated in the way they deal with mortgages. Sending out instructions into the traditional fragmented market, they have no control over how quickly and effectively the job is done.” Property Direct is divided into teams of six to eight paralegals, each one supervised by a solicitor and working on a shift basis. Mr New claims that it has cut the average time of a conveyancing operation by up to 50 per cent, to around six to eight weeks. Fees start from pounds 295 for sales or purchases. Property Direct currently employs 60 to 70 staff, a figure which Mr New aims to double by the end of the year. “Our view is that this is the future of conveyancing,” he says. “Not everyone will instruct a direct conveyancing operation, but people are becoming much more used to buying services directly from home using the phone. They dont want to take half a day off to see a solicitor.” Kevin Doolan, banking and finance partner at Eversheds, Britains biggest national law firm. Eversheds has co-operated with Hambro Countrywide in its Cardiff call-centre, opened last month, and a Manchester centre is due to open in April. Other national firms, Hammonds Suddards, Dibb Lupton Alsop and Addleshaw Booth Co are said to be keen to move into domestic conveyancing. Mr Doolan also anticipates a future of exponential growth, with the 100 or so staff currently employed in Cardiff and Manchester doubling in numbers every nine months. “Its an incredible rate of growth, but the demand is definitely out there,” he says. “All we are doing is mimicking things our lender clients have already done.” Doolan estimates that the conveyancing call-centres probably control around 5 per cent of a market worth anything up to pounds 500m. In two years time, he predicts this figure will reach 25 per cent, and as much as 40 per cent in five years. “Before Direct Line there were insurance brokers on every High Street. Where are they now? The only way small solicitors firms are going to be able to compete is by getting together and forming groups. Among the transactions funded on behalf of Corporate Properties Associates 15 Incorporated, part of the $6 billion W. P. Carey Group of income generating, publicly held, non-traded real estate investment trusts, were: The acquisition of a Belgian government office facility in Mons, Belgium, for 11.5 [euro] million ($14.7 million U.S.). The 90,000 s/f property will be leased for a period of 18 years. This is the first time the W. P. Carey Group has purchased a property in Belgium and it adds to its growing portfolio of properties in Europe. The $12.5 million acquisition of the corporate headquarters (two buildings) and primary call center from a leading business services company offering outsourced customer services and customer relationship management programs to Fortune 1000 firms. The 111,000 s/f facilities, located in Peoria, Illinois, will be leased under a 20-year, triple-net lease with two, ten-year renewal options. The purchase of two warehouse facilities from a leading supplier of plumbing repair products for $9.8 million.
As I prepared to write this article, the supply of capital for income producing real estate investments was reliably strong and abundant. Our capital markets/CMBS lenders were active, our local banking community was competitive and actually experiencing a healthy increase in market value; money continued to chase deals (albeit a little more cautiously) and supply seemed to out-strip demand. Although no one knows for sure how these events will affect the real estate finance market over the long run, we are hopeful that our lending community will continue to act objectively with prudence as they evaluate and underwrite our loan applications. Sterling Ruby, Marc Foxx, Los Angeles Sterling Ruby is a cool name, a drag queen name, a British spys name. I dont know him, and hadnt heard of him before I saw his show at Marc Foxx. That doesnt matter because his show, Interior Designer, which looks at sexuality, namely transgendered people, and flirts with theoretical schizophrenia, requires only sympathy for his observations and the art he makes. Four delicately scratched and key carved Formica laminate monoliths, each 7 x 4 x 4 are at the center of Interior Designer. Their tinted surface has dirty spots, handprints, chips, and evidence of handling. They recall the laminate prefabs in the displays and dressing rooms found in department stores. In their material and dimension they suggest–and maybe desire to be–video booth jack off chambers.
Literally and symbolically, Interior Designs is about interior and exterior designs. Its form parallels its content: it is divided into four major sections, each with approximately twenty chapters of between one and four pages. Instead of relying on plot, Jaffe writes short passages to illustrate various aspects of design, primarily the architecture of houses. In these passages the narrator describes all the houses she has lived in, none of which she has occupied for more than three years. In the section entitled The First House, the narrator and her husband, a rabbi, look for a new house. Instead of finding the right house, the right house seems to find them (throughout the novel structural components such as doors and windows are personified). The new house also has light shining from more than one direction, an entry for proper greetings and farewells, and a sense of solidity, all of which make the narrator feel infinite. Upon moving to the house, the narrator considers philosophical questions concerning fate, luck, guilt, and desire. These questions are exemplary of the novels themes–in every chapter of the novel, some aspect of exterior design is portrayed literally to illustrate metaphorically human emotions or philosophical issues. Sometimes the metaphors are a bit too obvious, and occasionally the narrator intrudes to explain them lest they slip past readers. For example, when looking at a house she decides against, she says all except one structural flaw is amendable. The minor flaws in the house are like little and medium-sized mistakes we all make in life–they were not irrevocable. For the most part, however, Jaffe has a wonderfully poetic style; remarkably enough, despite the lack of plot, the novel moves forward at a quick pace. The idea that you cant go home again recurs throughout the novel, but the implication is interestingly reversed, suggesting that to return to an earlier phase in ones fife would be to backslide. Textual and symbolic circular patterns develop in the novel that integrate the chapters with the text as a whole and that unite individuals with others and in a spiritual sense with the universe. Entertaining, witty, and full of philosophical insights, Interior Designs explores ways to find and maintain personal and spiritual peace.

The introduction of a coffee machine in the Nowra Library in September was welcomed by many of our users. However, it was not until we put in a cafe style cable and chairs that the usage increased. Decisions were made that users would be able to take their coffee, chocolate, etc into the library with only the PC area being out of bounds. Many people seemed reluctant to do this.The change in use and attitude was partially attributable to our young users, who during last years study vacation were purchasing chocolate drinks and bringing them to their study carrels and tables. Coffee houses have been regarded as cultural meeting places since the 17th century in western civilization when artists writers and political activists first started to meet and discuss topics of social interest over a cup of this stimulating drink. The poet Baudelaire in Paris in the 1840s described coffee as best served “black as night hot as hell and sweet as love.” Coffee seems always to have been part of the American landscape as it was a common feature on the chuckwagons of the prairie pioneers and cattle ranchers and in the break-rooms of companies and board rooms. Coffee is so popular in diners and roadside eateries that it is served almost as often as water. But for most of its history coffee was just coffee a commodity that was not associated with brand name or image. All that changed beginning in the 1980s as the result of a convergence of two trends. Americans looking for a socially-acceptable alternative to drug and alcohol intake were well-served by a proliferation of retailers eager to provide high-priced “gourmet” coffee to discriminating drinkers. Specialty shops such as Starbucks in Seattle and Peets Coffee in Berkeley have expanded to national chains whose popularity has eclipsed that of national brands such as Maxwell House and Folgers which spread across America in the fifties. In addition hundreds of independent cafeacute;s and coffee houses were founded in every major American city throughout the 1990s. In the Pacific Northwest–the capital of coffee consumption in America–drive-up espresso shacks line the roadsides providing a variety of coffee drinks to commuters willing to pay $3.50 for a 20-ounce Cafeacute; Mocha with a double shot of espresso. Even a small town like Snohomish Washington with a population of only 8000 boasts a dozen espresso shacks.
Coffee futures moved back above $1 in July, up from lows of 95 cents in mid-June. Prices likely will fluctuate because of the Brazilian weather for the next two months. There have been 17 freeze events in Brazil over the past 42 years, but only three in the past 21 years. Odds are we could see a significant price spike over the next six weeks. Traditionally, speculators bid up coffee prices ahead of the Brazilian winter, which runs from June through August. Then, if no frost damage occurs, prices tend to collapse by late August. John T. A recent investigation set out to test a novel approach to sustaining long-term contact with individuals after participation in a structured behavioral weight loss program. Two hundred and fifty-five (209 women and 46 men) overweight and obese adults were recruited through newspaper advertisements for participation in the study. Criteria for participation included age over 18, BMI greater than or equal to 25 kg/[m.sup.2], and a computer with adequate memory and connection speed. All subjects participated in an identical 6-month behavioral weight control intervention conducted over interactive television (ITV). Following weight loss, subjects were randomly assigned to one of three weight maintenance conditions: 1) Internet support (IS); 2) frequent in-person support (F-IPS); 3) minimal in-person support (M-IPS). All subjects were seen for assessment measures at baseline and at 6 months, 12 months, and 18 months. Main outcome measures included body weight, program adherence, and social influence components. There were no significant differences among the groups in weight loss (mean [+ or -] SD) from baseline to 18 months (7.6 kg [+ or -] 7.3 kg vs. 5.5 kg [+ or -] 8.9 kg vs. 5.1 kg [+ or -] 6.5 kg, p=0.23 for the IS, M-IPS, and F-IPS, respectively). Participants assigned to an Internet-based weight maintenance program managed similar weight loss over 18 months when compared with face-to-face counseling. It appears that Internet-based support is a viable means for promoting long-term weight maintenance.

This part starts with a historical account of the role of the Central Bank of Canada since its creation in 1934. Then, the author develops an interesting chapter about the proper role of a central bank for financial stability by looking at the Canadian experience regarding bank supervision, settlement management, systemic and liquidity crises, and the lender-of-last-resort operation. The Central Bank of Canada never has been directly involved in the supervision of banks, and John Crow is rightly unhappy with this situation: The Bank and what it knows cannot be ignored in supervisory decisions regarding financial institutions (p. 77). The second part of the book analyzes the Canadian experience concerning foreign affairs. The most interesting part concerns exchange rate matters. Canada has a long tradition of a flexible exchange rate regime.
